Children's Online Privacy Protection Act of 1998 (“COPPA”) Statement—
Thank you for visiting www.americaonthemove.org (“Website”). Our Privacy Policy (“Privacy Policy”) explains how we collect, use, and protect your information. Our Terms of Use (“Terms of Use”) describes the legal obligations and restrictions you agree to in exchange for being allowed to access and use our Website.

Together, these documents form a legally binding contract and include a lot of complicated legal promises and rules—if you are under the age of 18, you MUST share these agreements, especially the Terms of Use, with your parent or guardian (“Parent” or “Parents”) before using our Website.

  • If you do not agree to or understand any part of our Privacy Policy and/or Terms of Use, do not use our website or provide any information.
  • If you are under 18 years of age, please do not use our website until you have discussed our Privacy Policy and Terms of Use with your parents.
  • If you are under 13 years of age you must get your parents permission before you use our website or provide any information. Use of this website following verification of your parents’ consent will mean that your parent has agreed to be legally bound by our Privacy Policy and Terms of Use.

Note to Parents—
The safety and protection of your children while online begins with your involvement and guidance. Please read anywhere that we say “you” or “your” in this policy as both applying to: (a) your child, and to (b) you, as the parent expressly agreeing to be fully and completely responsible for your child. We follow the Direct Marketing Association’s (“DMA”) Children’s Guidelines and encourage you to learn more at the DMA's website. Also, we encourage you to visit the Get CyberSavvy! program to learn more about the use, collection and risks of online information. Note to Teachers—
The law requires that before you provide information belonging to a student under the age of 13, you first obtain the consent of that child’s parent or legal guardian. You are solely responsible for ensuring that any student under the age of 13 that you permit to participate in the online projects or activities offered by our website has obtained their parent’s consent to provide the necessary personal information to our website. Obtaining a parent’s consent to permit a student to use “the internet” is not sufficient-each parent must expressly consent to their child providing personal information to this website and you must inform the parent as to how they can review, delete, edit or otherwise restrict their child’s information. In addition, it is your duty to inform each parent from who you obtain consent of any changes to our policies of which we inform you.

Personal Information—
You will need to create an account to use certain parts of our Website. Generally, we will try to limit the personal information we request from you to non-personally identifiable information such as a screen name, birthday, gender, state, zip code and country of residence. Depending on what activities you sign up for, we may also ask for some limited personally identifiable information (“Personal Information”) including your first name and email address and the name and email address of your parent.

In compliance with the Children’s Online Privacy Protection Act of 1998, (“COPPA”), we require only the information necessary for the specific activity that you request; to participate in any activity on our Website, we ask you to disclosure only what is reasonably necessary to participate in that activity.

Parental Consent—
We ask users to provide their dates of birth to determine whether they are over 13 years of age. If you not that old, you will need to prove that you have your parents’ consent before we can create your account or accept any information from you.

We may use any of the following methods to verify that you have your parents’ consent:

  • At registration, we will require that you provide your first name and a parent’s valid email address. We will send your parent a notification email stating that you have requested to create an account on our Website and receive our e-newsletters on an ongoing basis and describing the information you provided at registration and contact information for your parent to respond and request that we stop sending you any emails, cancel your account, and/or delete, modify or edit your information. We will also use your parent’s email address to let your parent know about any changes to our Privacy Policy. Your parents may at any time review, change and/or delete any Personal Information that we have collected about you by emailing karen@americaonthemove.org. Your Personal Information is only used to send to you the electronic newsletters, communications or products that you requested. We do not sell, transfer or share your information with any other third party other than third parties engaged by us specifically to handle the preparation and delivery of those newsletters, communications or products or to perform other related technical and processing functions. We require that any third party who receives access to your Personal Information agrees to maintain your confidentiality.
  • We may also require a valid credit card number to validate your parent’s identity and verify that he/she/they have given their permission for you to create an account. We do not charge any amount to this credit card and we do not retain this information after we have validated your parent’s identity. We simply use the credit card number to request that the credit card issuer confirm your parent’s identity.
  • If your account is being created by a teacher, your teacher must first obtain your parent’s consent. If your teacher creates a student account for you without your parent first signing a consent form, please inform your parent immediately so that they can instruct us to remove your information from our files.

Usage Information—
Our Website may also use certain technologies such as “cookies,” to track how you use our Website. This information is anonymous and does not personally identify you. You may also reject cookies, but doing so may limit your use of our Website. We do not use spy ware, adware or any other similarly intrusive software.

Use of Information Collected—
If you are over the age of 13, we may use your Personal Information to contact you, respond to your inquiries, and send you other information we think you may be of interest to you, such as special offers or to notify you of important new changes to our Website. If you are under 13 years of age, we will only use your Personal Information to provide you with services and/or information that you have specifically requested and for which we have your parents’ permission to provide.

WARNING: any personal information (e.g., name, email address, personal photographs) that you voluntarily disclose on any bulletin board, message board or on any other community forum offered on the website may be collected and used by parties other than us and may result in unsolicited messages from other parties. If you ARE UNDER 13 YEARS OF AGE, WE EXPRESSLY PROHIBIT THE POSTING OF ANY PERSONAL information anywhere on our website, including on any message board. If you believe that any child under the age of 13 has posted any personal information anywhere on our website, please contact us immediately at karen@americaonthemove.org and provide as much information as you can to help us locate and delete the personal information. If you post personal information on any message board we have no control over this use of your personal information and, as such, cannot be responsible for it. We reserve the right, but not the obligation, to: (a) delete any personal information we discover or which is brought to our attention, at any time, for any reason whatsoever; (b) immediately terminate your account and/or (c) contact your parents regarding the posting.

Disclosure of Your Information—
We may disclose your information: (a) when we have reason to believe that such disclosure is necessary to identify, contact or bring legal action against someone who may be causing injury to or interference to our rights or property, or those of other users of the Website, or anyone else who could be harmed by such activities, including you. We may reasonably disclose such information as necessary to enforce our Terms of Use or protect our legal rights or the security of our Website. We will also provide information to law enforcement agencies or in response to judicial process in connection with an investigation on matters related to public safety, or if we have a good-faith belief that such action is necessary to comply with state and federal laws. Subject to COPPA, we may disclose certain portions of your information to our business partners that conduct research, analytical and marketing function on our behalf.

Group administrators can pull reports on their group participants. These reports can include your name, email address, mailing address, phone number, and activity logs. Many group administrators reference this as part of group challenges. By joining a group, you understand the administrator(s) has access to and may use this information. Please contact your group administrator to determine how they will use this data. Your individual height, weight, and BMI are never shared with your group administrator(s).

AOM and group administrators may extract data from your Personal Information and aggregate it with the same data of other users. This “Aggregate Data” does not specifically identify you. You agree to allow us to disclose and publish Aggregate Data on an Aggregate Basis (as defined below) to any party through any means, including without limitation through press releases, advertising, journal articles, sponsorship/funding initiatives, or other communications. "Aggregate Basis" means that we combine parts of your Personal Information that do not contain your name with other information from any number of other users/visitors to the Site for any given period of time. The intent is not to disclose the Personal Information of individual users, even if it is possible for some to guess what individuals may have been involved.

Transfer—
We may sell or buy other businesses or entities. If we do, we may transfer or assign the information we have collected, including your Personal Information, as part of such merger, acquisition, sale, or other change of control. Also, in the unlikely event of our bankruptcy, insolvency, reorganization, receivership, or assignment for the benefit of creditors, or the application of laws or equitable principles affecting creditors' rights generally, we may not be able to control how your Personal Information is treated, transferred, or used and your Personal Information may be included in the transferred assets. We do not sell Personal Information to third parties and have no intention of doing so in the future. Under the laws of some jurisdictions, you may be entitled to request disclosure regarding how we share your Usage Information with third parties for direct marketing purposes (“Information-Sharing Disclosure”). To the extent required by applicable law, we shall provide the Information-Sharing Disclosure to you upon rightful request made in writing to 4455 E 12th Ave., Suite 300, Denver, Colorado, 80220. Except as explained above, we will not share any of your personal information with any third party, unless we have received your express permission to do so.

Opting-Out—
You may opt-out of receiving any communications for which you or your child has signed up at any time by clicking on a link provided at the bottom of the email communication or by contacting info@americaonthemove.org.

As AOM is a research-based non-profit organization, we often use Aggregate Data for research purposes. For this purpose, we may store your information indefinitely for our business and research records. You can disable your account to stop interacting with the Website and receiving communications from AOM by editing your profile settings. Your account will not be deleted. It will be archived and used in Aggregate Data from that point forward. Only accounts of children 13 and under will be deleted per written request of their parent or legal guardian.

Linked Sites—
Our Website may include, as a convenience to you, links to other websites. Each linked website will have its own rules and policies with respect to how it collects, uses and discloses your personal information. These sites are not part of this website. Make sure you and your parents review the applicable agreements and policies carefully when visiting other websites. We are not responsible for or have any control over other websites and we do not endorse any product on other websites.

Security Procedures—
Once we receive your Personal Information, we will take steps that we believe are commercially reasonable to safeguard your Personal Information. However, we cannot guarantee that your Personal Information may not be accessed, disclosed, altered, or destroyed as a result of a breach of our efforts or as a result of any other event beyond our reasonable control. We also cannot and do not guarantee the security of any information transmitted over the Internet before it reaches us. WE EXPRESSLY DISCLAIM ANY REPRESENTATION OR WARRANTY, WHETHER EXPRESS OR IMPLIED, WITH RESPECT TO ENSURING, GUARANTEEING OR OTHERWISE OFFERING ANY DEFINITIVE PROMISE OF SECURITY IN CONNECTION WITH YOUR PERSONAL INFORMATION OR USAGE INFORMATION.

Changes and Updates to the Privacy Policy—
From time to time, we may revise the Privacy Policy and/or Terms of Use. To help you stay current of any changes, we take the following three steps: (1) we note the date the Privacy Policy or User Agreement was last updated above; (2) when we make a change to the Privacy Policy and/or Terms of Use, we post conspicuous announcement of such changes on the homepage of the Website for 30 days following the date the Privacy Policy and/or Terms of Use was updated; and (3) if you are 13 years old or younger, we will email notice your parent at the email address provided during registration when we make any change to our Privacy Policy. Your use of the Website following the foregoing shall be deemed acceptance of the revised policy.
